The rules for using Nomenwise, in plain language. Results are estimates and not customs advice.
These terms govern your use of the Nomenwise website and service ("Service"), provided by Nomenwise ("we", "us"). By using the Service you agree to them. If you use it for a company, you confirm you may bind that company. The Service is for business use only.
Nomenwise suggests tariff classification codes for products in a spreadsheet you upload, with a confidence score, and shows related tariff information. The first release covers US destinations. Other destinations, an API and alerts are planned and not promised.
We are preparing to launch. Until then the website lets you join a launch list and ask us questions. Features, limits and pricing may change before and after launch.
Results are estimates. They are not legal, customs, tax or trade advice, and we are not a customs broker. The confidence score ranks options and is not a promise that a code is correct. You are responsible for the classification and duties you declare, and should check results, especially rows with lower confidence, against the official tariff schedule or with a qualified professional. Tariff rules change often, and the information we show may be out of date.

We may limit, suspend or remove access if you break these terms or put the Service at risk.
You keep all rights in the files you upload and the results we return. You give us a limited licence to process them to provide the Service to you, and to keep them for the period stated in our Privacy Policy. We use the content of your files to improve the Service only if you agree, or in a way that cannot identify you or your company.
The Service, its software, design, trademarks and underlying data compilations belong to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use the Service under these terms. Tariff schedules and notices come from public government sources, which we link to where we can.
Free access, if offered, is provided as is, may have limits such as a maximum number of rows, and can change or end at any time.
To the fullest extent the law allows, the Service is provided "as is" and "as available", without promises of accuracy, completeness, availability or fitness for a particular purpose. Nothing here limits rights you have by law that cannot be limited.
To the fullest extent the law allows, we are not liable for indirect or consequential loss, lost profit, duties, penalties, fines, storage or demurrage costs, or delays arising from your use of or reliance on results. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and USD 100. Nothing limits liability that cannot be limited by law, including for fraud, intentional misconduct, or death or personal injury caused by negligence.
You are responsible for your files and for how you use results. You will cover reasonable losses we suffer from third-party claims caused by content you uploaded in breach of these terms.
You can stop using the Service at any time. We can end or change it with reasonable notice where possible. Sections that by nature should survive, such as ownership, liability and governing law, continue after use ends.
These terms are governed by the laws of Ukraine, and disputes go to the competent courts of Ukraine, unless mandatory law gives you the right to use the courts of the country where you are established. If you are in the EU or UK, this does not remove rights that apply to you by law.
We may update these terms. If a change is meaningful we will tell you by email or on the website before it applies. Continued use after that means you accept the new terms.
